What is a Reg 126 Certificate of Compliance?
A Regulation 126 certificate is a Certificate of Compliance required in Victoria, Australia, under the Building Regulations 2018. It is issued by a registered building practitioner, such as a qualified engineer, to certify that proposed or completed building work complies with the relevant building legislation, regulations, and standards. This certificate gives the Relevant Building Surveyor (RBS) the assurance to approve aspects of a building project, particularly for complex designs.
When is a Structural Reg 126 Certificate of Compliance Required?
A Structural Reg 126 Certificate of Compliance may be requested by the Relevant Building Surveyor in the following situations:
For a Demolition Permit - where the demolition process involves a level of complexity or risk which is beyond the knowledge and experience of the RBS, the RBS may request for a structural engineer to certify the demolition methodology.
For a Building Permit - the RBS will generally request a Reg 126 Certificate of Compliance to certify that the structural engineering design documentation complies with the relevant building legislation, regulations and standards.
During Construction - where the RBS lacks the appropriate knowledge or experience to undertake a structural inspection, or the built structure differs from that shown on the engineering design drawings, the RBS may request for a structural engineer to certify that the built structure complies with the relevant building legislation, regulations and standards.
For a Performance Solution - where the design or construction does not follow the deemed-to-satisfy provisions, an engineer may be required to demonstrate that the design achieves the same or better performance requirements as the deemed-to-satisfy solution through verification methods such as calculations or testing.
